Attestation of Workplaces: Requirements, Documents and Choosing the Right Service
Every year, dozens of Azerbaijani enterprises face the same problem during the inspection of the Labor Inspectorate: they have attestation documents, but they were either prepared by an unaccredited institution, or the measurement protocols are defective, or the risk assessment table is incomplete. The result is the same every time — the documents lose legal force, the enterprise is sanctioned, the whole process starts from scratch.
Attestation is not a formal procedure. When done correctly, it protects the enterprise from legal risks, documents the health of employees and creates a reliable defense against government audits. This article explains that process from start to finish.
Who is obliged to certify workplaces?
Article 213 of the Labor Code of the Republic of Azerbaijan and Resolution No. 38 of the Cabinet of Ministers make attestation of workplaces on working conditions mandatory for all employers. This requirement does not depend on the field of activity, enterprise size and form of ownership.
Oil and gas, construction, production, transport — the need for certification in these areas is clear. But the same requirement applies to the office environment, the commercial sector, service enterprises and small companies. The law does not provide for any exceptions based on the number of employees.
How long is the attestation valid for?
Attestation should be held once in 5 years. However, re-attestation is required without waiting for the next cycle in the following cases:
- When the technological characteristics of the production process change
- When new equipment is put into use
- When the physical environment of the workplace is fundamentally changed
- When an industrial accident occurs at the enterprise
- When an occupational disease is registered by the employee
What Factors Are Measured in Workplace Attestation?
The technical essence of the certification consists of the instrumental measurement of harmful factors in the work environment. These measurements are not made on the desk — the specialist should measure by observing the actual working conditions, working equipment, live production process.
Physical Factors
Noise decibel, vibration frequency, lighting intensity, electromagnetic field voltage, air temperature and humidity are included in this group. Those indicators must be measured while the work is in progress — a measurement made in an empty or non-working environment is considered invalid.
Chemical Factors
The concentrations of dust, steam, gas, and aerosols originating from the production process are measured. This measurement is especially critical in workplaces working with paint, adhesive, fuel, chemical solvent, metal powder.
Biological Factors
Relevant indicators are evaluated for workplaces working with microorganisms, biological materials, plant and animal raw materials.
Psychophysiological Factors
Monotonous work rhythm, the same body position for a long time, visual-emotional overload, decision-making intensity belong to this group. These factors are mostly ignored in office environments, while a significant proportion of long-term occupational diseases are related to these factors.
Each measurement result is compared with the sanitary norms, hygiene norms and GOST standards of the Republic of Azerbaijan. When an abnormal indicator is detected, that workplace is included in the "harmful" or "dangerous" category.
Workplace Attestation Document Package: What is Required for Verification?
During the inspection of the Labor Inspectorate, three main elements of the attestation package are checked. Each must be complete, properly formatted and authenticated by appropriate signatures.
Measurement Protocols
Separately prepared document for each workplace — includes measurement date, location, name of used device and calibration certificate, measurement result, normative indicator and comparative assessment. Without a device calibration certificate, the protocol is not legally binding.
Risk Assessment Table
Determined risk degrees based on measurement results: satisfactory, permissible, harmful (grade 1-4), dangerous. It is this table that forms the legal basis of the employee's social privileges — additional leave, salary supplement, shortened working hours, early retirement rights.
Plan of Events
A specific, time-bound corrective action plan for identified outliers. The absence of a plan indicates that the attestation has not been completed.
Attestation may not be accepted if any of these three documents are missing.
Why is Accreditation Important When Choosing an Attestation Service?
The right to certify workplaces in Azerbaijan belongs only to accredited inspection bodies registered in the register of the Azerbaijan Standardization Institute (AZSTAND). This status is obtained according to the AZS ISO 17020:2021 standard.
In practice, many enterprises receive attestation services from non-accredited institutions. These institutions prepare documents, complete protocols — but the results do not carry legal force. During the inspection, the inspector checks the accreditation number of the service provider directly from the AZSTAND register. If accreditation is not found, the entire document package is considered invalid.
What to Ask Before Ordering Service?
- Copy of the institution's accreditation certificate issued by AZSTAND
- Checking from the registry that the accreditation is currently valid
- Calibration certificates of measuring devices to be used
Rights Acquired by the Employee as a Result of Attestation
According to the risk category determined as a result of the attestation of workplaces on working conditions, the following social benefits are legally recognized for employees:
Additional Leave Right
Employees working in harmful conditions are granted additional leave of up to 6 working days in addition to the basic leave.
Wage Supplement
An interest supplement is calculated on the tariff salary — this percentage varies depending on the specified risk level.
Shortened Working Hours
For some categories, the working week is reduced to 36 hours.
Medical Protection
In appropriate cases, the costs of therapeutic and preventive nutrition, health examination are paid by the institution.
Right to Early Retirement
Certain professional categories documented by attestation are entitled to early retirement.
These privileges are not a voluntary decision of the enterprise — they are a legal obligation. Any concession given without attestation has no legal basis and may cause problems in the inspection of the inspector.
